Carbondale man found guilty of manslaughter

An Osage County jury has found a Carbondale man guilty of involuntary manslaughter while driving under the influence of alcohol, in connection with a fatality wreck that occurred in Feb. 20, 2008, near Michigan Valley.

The jury also found Justin Spencer, 25, Carbondale, guilty of driving while a habitual violator. The charges stem from a rollover accident that claimed the life of 27-year old Jessica Alford, Scranton.

According to a Kansas Highway Patrol report, Alford was the passenger in a 1998 Dodge passenger car driven by Spencer, when the vehicle went off Stanley Road about 5.5 miles north of state Highway 268 and rolled numerous times. Alford was partially ejected from the vehicle and died at the scene. Spencer was extricated from the vehicle and transported to an Overland Park hospital.

Neither Alford nor Spencer were wearing a seatbelt, according to the report.

Spencer was arrested May 7, 2008, by the Kansas Highway Patrol. The jury reached a guilty verdict on both counts around noon last Thursday, after a several-day trial.

Spencer remains in custody on $100,000 bond with sentencing scheduled for 11:30 a.m. June 15.

According to Osage County Attorney Brandon Jones, Spencer is facing a possible 66 months in prison for the convictions.
