OSAGE CITY—An Osage City man has been booked into jail on charges of involuntary manslaughter and driving under the influence of alcohol following a fatality accident early Sunday morning east of Osage City. According to the Kansas Highway Patrol, a passenger, Javier G. Rodriguez, 30, of Ottawa, died as a result of his injuries in the rollover accident.

Ruben S. Callejas, 43, Osage City, was the driver of the 2003 Hummer H2 according to the highway patrol.

The highway patrol report said the vehicle was westbound on state Highway 31 at 2:23 a.m. Sunday when it crossed the centerline and entered the south ditch. The vehicle struck a street sign and a dirt embankment before flipping several times and coming to rest on its top just west of Lewelling Road.

Callejas and another passenger, Luis A. Sanchez, 27, Ottawa, were listed in the report as possibly injured, but a highway patrol spokesperson said both declined transport to a hospital. Both were wearing seatbelts according to the highway patrol. Rodriguez was not wearing a seatbelt.

As of Tuesday, Callejas was being held in the Osage County Jail on a $100,000 bond. Osage County Attorney Brandon Jones said Tuesday that formal charges were pending until final reports are received from the highway patrol.
